LA Cable (“ShoutcastStreaming”) agrees to furnish services to the Subscriber, subject to the following TOS (Terms of Service).

Use of ShoutcastStreaming’s Service constitutes acceptance and agreement to ShoutcastStreaming’s TOS (Terms of Service).

All provisions of this contract are
subject to the TOS (Terms of Service) of ShoutcastStreaming. The TOS may be changed from time to time at the discretion of ShoutcastStreaming. Subscriber understands that change to the TOS by ShoutcastStreaming shall not be grounds for non-payment.


ShoutcastStreaming
reserves the right to cancel or suspend any account for any reason. An account may be canceled or suspended immediately when any breach of the following Terms of Service is found, in such cases no refund will be issued. Setup fees (if any) will not be refunded.

Privacy Policy
ShoutcastStreaming respects your privacy! Any and all information collected on this site or our affiliates will be kept strictly confidential and will not be sold, rented, disclosed, or loaned! Any information you give to us will be held with the utmost care and will not be used in ways that you have not consented to.

Order Information
It takes up to 24 hours to set up your order.  If you don’t want to wait that long, we understand if you have to order through another Stream Host.  We are not open 24 hours per day and orders will be filled as quickly as possible.

ABSOLUTELY NO REFUNDS WILL BE GIVEN FOR 1st MONTH OF SERVICE.  Please make sure that you are ordering the correct item for your needs.  However, we will issue a credit to be used on any other product for that month.

Code of Conduct
All customers are expected to conduct their actions on support tickets / phone calls in a professional manner.  We will not tolerate people that use vile language, constantly berate us, rude behavior or harass us in any way.  Violation of this rule will be grounds for us to cancel your account.

Communication
ShoutcastStreaming will communicate with its customers through e-mail on issues related to our service. It is the responsibility of the customer to check any e-mail sent to the e-mail address provided. The customer is responsible to notify ShoutcastStreaming of any e-mail address changes.

Account Billing
The account will be on a month to month basis.  We request a two (2) week notice if you intend to cancel our service.  Your account will automatically renew until you cancel.

If you have elected to utilize PayPal’s Subscription option to pay your hosting fees, you are responsible for managing your own PayPal Subscription.
ShoutcastStreaming
does not manage or monitor PayPal Subscription activity and is not responsible for errors relating to PayPal Subscriptions.

CANCELLATION – This means that if you cancel your service with us, or switch payment methods from PayPal to Credit Card, you are responsible for canceling your own PayPal subscription through your PayPal account. ShoutcastStreaming cannot do this for you. Refunds are not granted if you fail to cancel your PayPal subscription.
PayPal & Subscriptions

PayPal Subscriptions.
ShoutcastStreaming offers the option to use PayPal Subscriptions as a convenience to the Customer to set up convenient automatic payments. PayPal Subscriptions are an agreement ONLY between the Customer and PayPal and do not involve any agreements with ShoutcastStreaming. PayPal Subscriptions are 100% managed by the Customer and not by ShoutcastStreaming. ShoutcastStreaming cannot cancel any PayPal Subscriptions. Therefore, should the Customer cancel their service or switch payment methods to a different payment method such as direct credit card billing, the Customer is responsible for the cancellation of their own PayPal Subscription through their PayPal account. ShoutcastStreaming is not responsible for canceling ANY PayPal subscriptions. In addition, the Customer agrees that ShoutcastStreaming will not be held liable for any fees incurred by any PayPal Subscription payments,
erroneous or otherwise, such as Bank NSF fees, Over Limit fees, or other fees associated with payment methods linked with the Customer’s PayPal
account, and or any PayPal Subscription agreements between PayPal and the Customer.”

How to Cancel your PayPal Subscription:
– Go to your PayPal account, and find the transaction where PayPal sent a payment to us.
– Click on the blue “Details” link.
– At the top you should see something about a Subscription Payment Transaction ID # and then “In reference to S-XXXXXXXXXXXXXXXXXXX” (where the x’s are is your Subscription number).
– You should click on the Subscription Number which should be blue and hyperlinked.  This will take you to the subscription page.
– There will be a gray button at the bottom that says “Cancel Subscription”.
– Click that button and PayPal will cancel your PayPal subscription.

DOUBLE PAYMENTS – Additionally, if you are an active hosting customer and you find that Paypal has taken a double-payment, WE DID NOT DOUBLE BILL YOU. This means you accidentally created a 2nd PayPal subscription. If this happens, you are responsible for canceling the duplicate PayPal Subscription. Refunds are not given for accidental duplicate subscription creations. This situation is simple to rectify. When we receive duplicate payments generated by your PayPal account, it is applied as an account credit. You should then cancel BOTH your PayPal subscriptions. Payment for future invoices will
be taken out of your account credit. When your account credit runs out, you should re-create a PayPal Subscription or utilize our convenient Credit Card payment option in order to pay future invoices.

Cancellation
A two week notice is requested if you want to cancel.  Your account will remain active until the end of the period that was paid for.

Dedicated Server
We have to place an order with, and pay the Data Center for one month of service if you order a Dedicated Server.  For that reason, there are NO REFUNDS after you order and pay for a Dedicated Server.  We don’t get a refund from the Data Center, and hence, we can not refund you.

Please back up your data.  We do not back up your server.  We are not responsible for loss of data, which may happen with disk drive(s) gone bad, power surges that loses data, etc.

A strict 30 notice is required to cancel a Dedicated Server.   Failure to comply with this rule will result in payment collection attempts by ShoutcastStreaming for the 30 days.  Dedicated Servers are expensive and the Data Center sets that rule for cancellations.

SPAM and / or BULK emailing is strictly prohibited.  If we receive any abuse reports that you are doing this, your server will immediately powered down and will not be renewed.  No money will be returned to you for the unused portion of payment.

We have a ZERO TOLERANCE against SPAM and / or BULK emailing.  If you are caught, you will be terminated immediately.

Since we do not allow SPAM or BULK emailing, we also will not set up reverse DNS (rDNS).  These are notoriously used for BULK emailing purposes.

Do not change the SSH port from 22.  If you do, you must open up that port on the filewall(s).  If you don’t you will get locked out of your server.  To break into your server, we charge a one time fee of $65:

Refunds
Once an account is signed up, there are no refunds for that month.

If we decide that a refund is justified, the refund will be in the same form as the payment. If a credit or debit card payment, the refund will be given against the same card number. If a PayPal payment, the refund will go to the same PayPal email.

Late Payments / Termination
After an invoice is over 5 days overdue, a late fee of $2.00 will be applied.  If the account is not brought up to date, all MP3 files, server logs, statistics may be deleted.

Late fee on a Dedicated Server is $10.  This will be applied if the payment is 2 days or more overdue.

Royalties & Account Uses
Customer is solely responsible for any applicable license fees for their streams or websites. 

ShoutcastStreaming does not provide licensing for any programming including but not limited to ASCAP, BMI, SESAC, RIAA, SIAE, GEMA, CARP, MP3, or MP3pro.

The account holder will be responsible to make sure the users of his or her account fully comply with the Terms of Service.

Bandwidth and Resources
ShoutcastStreaming offers an unlimited bandwidth policy by maintaining large ratios of bandwidth per customer. ShoutcastStreaming reserves the right to suspend or terminate any  account immediately that stream at higher bit rates than purchased. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of the servers.

3rd Party Software
We are not responsible for any 3rd party software that we use.  If there are issues with the software, the issue must be resolved between the software company and yourself.  For example, the Centovacast Control Panel is a product of Centova (http://www.centova.com).
It is their package and we just lease it. If there are features that you believe are not working as they are supposed to, the resolution must be worked out with them.  Since we DO NOT have the source code, we can not diagnose such issues.

FLASH Player
The FLASH player(s) must run on our servers.  The URL is something like:

.  You may not either try to put the SWF file on your server or reverse engineer the
code.  You may not try to break into our RTMP server for the purpose of stealing our bandwidth.  This will result with an immediate suspension of your service.  No refund of your money will be given.  This is a strict policy. no warnings will be given.  If we find you are trying to steal our bandwidth, we will report you to your ISP.

Disclaimer
ShoutcastStreaming makes no warranties of any kind, whether expressed or implied, for the service it is providing.   ShoutcastStreaming will not be responsible for damages or losses the customer suffers, and any consequential damages or losses. This includes, but not limited to the loss of data, non-deliveries,
mis-deliveries, or service interruptions caused by its own negligence, subscriber’s errors or omissions, or due to the fault of any third parties.

Competitors
ShoutcastStreaming reserves the right to not allow competitors access to our services and / or our website.  We have found that they usually try to copy our site or services to enhance their own endeavors.
